These Terms and Conditions ("Agreement", "Terms") constitute a legally binding agreement between you ("Player", "User", "you") and BabaWin ("BabaWin", "we", "us", "our"), the operator of the online gaming platform accessible at https://babawin.casa ("Platform", "Website", "Service").

BabaWin operates as an international online gaming platform offering casino games, sports betting, live dealer games, and related entertainment services. Our Platform is designed for, and primarily marketed to, adult players across Malaysia, including but not limited to those residing in Kuala Lumpur, Petaling Jaya, Shah Alam, Johor Bahru, Penang, and other states and territories throughout the country.

By accessing the BabaWin Platform, creating an account, making a deposit, participating in any game, claiming any bonus, or otherwise using any part of our Service, you unconditionally agree to these Terms in their entirety. If you do not agree to these Terms, you must immediately cease using the Platform and close your account.

BabaWin reserves the right to modify these Terms at any time. Continued use of the Platform following any published amendment constitutes your acceptance of the revised Terms. We recommend that users review these Terms periodically to remain informed of any updates.

For the purposes of these Terms, the following definitions shall apply:

To be eligible to register for and maintain a BabaWin Account, you must meet all of the following criteria at the time of registration and on an ongoing basis throughout your use of the Platform:

1. Age Requirement: You must be at least twenty-one (21) years of age. BabaWin strictly prohibits access to or use of its Platform by any person under the age of 21. This requirement is non-negotiable and applies regardless of the legal gambling age in any particular jurisdiction.
2. Legal Capacity: You must have full legal capacity to enter into a binding agreement under the laws of your jurisdiction. Persons who are legally incapacitated, under guardianship, or otherwise lacking legal capacity are prohibited from registering.
3. Individual Registration: Accounts may only be registered by natural persons acting in their individual capacity. Corporate registrations, registrations on behalf of another individual, and registrations using false identities are strictly prohibited.
4. One Account per Person: Each individual may hold only one (1) active Account on the BabaWin Platform. Multiple accounts belonging to the same individual — whether identified by shared name, address, payment method, IP address, device, or other identifying information — are prohibited and may result in account suspension and forfeiture of funds.
5. Jurisdiction Compliance: You must not be located in, a resident of, or otherwise subject to the laws of a Prohibited Jurisdiction. You are solely responsible for ensuring that your use of the Platform complies with all applicable laws in your jurisdiction.
6. Not Self-Excluded: You must not be subject to any active self-exclusion arrangement, whether implemented through BabaWin or through any third-party responsible gambling programme.

4.1 Registration Process

To register a BabaWin Account, you must provide accurate, complete, and current information including your full legal name, date of birth, valid email address, and contact number. You agree to keep this information current and to notify BabaWin promptly of any changes. BabaWin reserves the right to reject any registration application at its sole discretion without being required to provide reasons.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your Account login credentials, including your username and password. You must not share your credentials with any third party or permit any other person to access or use your Account. You agree to notify BabaWin immediately at [email protected] if you become aware of any unauthorised access to or use of your Account.

4.3 KYC Verification Obligations

BabaWin requires all Players to complete KYC verification before processing any withdrawal request. Verification requires submission of: (a) a valid government-issued photo identification document — Malaysian MyKad (IC), driver's licence, or passport; (b) proof of residential address dated within three (3) months — utility bill, bank statement, or official government correspondence; and (c) a selfie photograph holding your identification document. Failure to complete KYC within a reasonable timeframe may result in suspension of withdrawal privileges or Account closure.

4.4 Account Currency

BabaWin Accounts are denominated in Malaysian Ringgit (MYR) as the primary currency. Cryptocurrency deposits (BTC, ETH, USDT TRC20, BNB) are accepted and converted to MYR equivalent at the prevailing exchange rate at the time of transaction. All balances, bonuses, and withdrawal amounts are displayed and processed in MYR unless otherwise specified.

5.1 Accepted Payment Methods

BabaWin accepts deposits via the following payment methods, subject to availability at the time of transaction: Touch 'n Go eWallet, Boost, GrabPay, DuitNow, FPX (Financial Process Exchange — all participating Malaysian banks), Maybank2u (Maybank online banking), CIMB Clicks, Public Bank online banking, Hong Leong Connect, and select cryptocurrencies (BTC, ETH, USDT TRC20, BNB).

5.2 Minimum and Maximum Deposit Limits

The minimum deposit amount is RM30 for e-wallet and DuitNow methods, and RM50 for bank transfer methods. The maximum deposit per transaction is RM30,000, subject to the limits imposed by your chosen payment provider. BabaWin reserves the right to set additional deposit limits at its discretion and to request documentation for large deposits as part of AML compliance obligations.

5.3 Withdrawal Policy

Withdrawals are processed only to payment methods previously used for deposits and only to accounts in the name of the registered Account holder. BabaWin will not process withdrawals to third-party accounts under any circumstances. All Players must complete KYC verification before any withdrawal is processed. The minimum withdrawal amount is RM50. Processing times are generally within 30 minutes for verified accounts using e-wallet and DuitNow methods, and within 5–15 minutes for FPX bank transfers, though BabaWin does not guarantee specific processing times in all circumstances.

5.4 Anti-Money Laundering

BabaWin operates in full compliance with applicable anti-money laundering (AML) and counter-terrorism financing (CTF) regulations. BabaWin reserves the right to request source-of-funds documentation for any transaction, to delay or withhold withdrawals pending investigation, and to report suspicious transactions to relevant authorities as required by law. Players must not use BabaWin for any purpose related to money laundering or financial crime.

BabaWin offers various bonuses and promotions to eligible Players. All bonuses are subject to the specific terms stated on the applicable promotion page and to the general bonus conditions set out in this clause. In the event of any inconsistency, the specific promotion terms shall prevail.

6.1 General Bonus Conditions

• Bonus offers are available to eligible Players who are 21 years of age or older and whose Accounts are in good standing.
• Each promotion may only be claimed once per Player, per household, per IP address, and per device unless otherwise stated.
• Bonuses are credited as Bonus Funds and are subject to wagering requirements before conversion to withdrawable cash.
• Wagering requirements must be met within the time period specified for each promotion. Unused Bonus Funds will expire upon lapse of the stipulated period.
• BabaWin reserves the right to cancel, modify, or withdraw any bonus offer at any time with reasonable notice.
• Players who are found to have exploited bonuses, used bonus abuse strategies, or engaged in matched betting using bonus funds may have their bonuses forfeited and their Accounts suspended.

6.2 VIP Programme

BabaWin operates a six-tier VIP programme comprising Bronze, Silver, Gold, Platinum, Diamond, and Royal Black Diamond levels. Advancement through VIP tiers is based on monthly wagering turnover thresholds. VIP benefits, including cashback rates, birthday bonuses, withdrawal priority, and personal account manager access, are subject to the VIP Programme terms applicable at the time and may be varied by BabaWin with notice. Membership in the Royal Black Diamond tier is by invitation only at BabaWin's sole discretion.

6.3 Cashback and Rebate Promotions

Cashback and rebate promotions are calculated on net losses over the specified calculation period. Cashback awards are credited as Bonus Funds or real cash as specified per promotion. BabaWin's determination of cashback amounts is final and conclusive.

7.1 Game Rules

All games offered on the BabaWin Platform are governed by their respective game rules, which are accessible within each game interface. Players are responsible for familiarising themselves with the rules of any game before placing real-money wagers. BabaWin provides games sourced from internationally accredited third-party game providers whose products are independently audited for fairness and randomness.

7.2 Sports Betting

BabaWin offers sports betting markets covering Liga Super Malaysia, the English Premier League (EPL), the FA Cup, UFC, NBA, Formula 1, and other sporting events. Betting markets, odds, and bet types are subject to availability and may be suspended or removed at any time, including during live events. All bets are settled according to the official results from the relevant governing body or sports organisation. BabaWin's decision on bet settlement is final subject to any dispute resolution procedure.

7.3 Technical Malfunction

In the event of a technical malfunction, disconnection, or software error during any game session or bet placement, BabaWin will use commercially reasonable efforts to restore game state. Where restoration is not possible, any affected bets may be voided and stakes returned to the Player's Account. BabaWin is not liable for losses arising from technical failures beyond its reasonable control.

7.4 Disputed Outcomes

In the event of a dispute concerning a game outcome or bet settlement, the Player must raise the dispute with BabaWin's customer support team within seven (7) days of the disputed event. BabaWin will investigate the matter and respond within five (5) business days. BabaWin's determination following investigation shall be final unless the matter is escalated through a formal dispute resolution procedure.

BabaWin is committed to promoting responsible gambling practices. We recognise that gambling should be a form of entertainment and not a means of generating income or resolving financial difficulties. We take our duty of care to Players seriously.

All Players may access the following responsible gambling tools directly from their Account settings at no charge:

• Deposit Limits: Set daily, weekly, or monthly maximum deposit amounts.
• Loss Limits: Set maximum loss thresholds over defined time periods.
• Session Time Limits: Receive reminders and automatic session endings after specified play durations.
• Cool-Off Periods: Temporarily restrict access to your Account for a defined period.
• Self-Exclusion: Permanently or temporarily exclude yourself from accessing the BabaWin Platform.

The following conduct is strictly prohibited on the BabaWin Platform. Engagement in any of the following may result in immediate Account suspension, forfeiture of all balances, and where applicable, referral to law enforcement authorities:

1. Registering an Account if you are under 21 years of age or are legally prohibited from gambling.
2. Providing false, inaccurate, or misleading information during registration or KYC verification.
3. Registering or operating more than one Account on the Platform.
4. Using the Platform for any money laundering, financial fraud, or criminal activity.
5. Using automated systems, bots, scripts, or artificial intelligence tools to gain an unfair advantage over the Platform or other players.
6. Engaging in collusion with other players in any game mode.
7. Exploiting software errors, glitches, or vulnerabilities in any game or Platform system.
8. Engaging in bonus abuse, arbitrage betting, or matched betting using BabaWin bonus funds in a manner designed to circumvent the spirit of promotional terms.
9. Attempting to charge back, reverse, or dispute any genuine deposit transaction with your payment provider.
10. Engaging in any conduct that disrupts, damages, or impairs the proper functioning of the Platform or the experience of other users.

All content on the BabaWin Platform, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, game content, and all other material, is the property of BabaWin or its content suppliers and is protected by applicable intellectual property laws.

BabaWin grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your personal, non-commercial entertainment purposes in accordance with these Terms. This licence does not permit you to: reproduce, distribute, display, sell, rent, or create derivative works from any Platform content; reverse engineer, decompile, or extract source code from any game or Platform software; or use any BabaWin trademarks or brand elements without prior written consent.

To the fullest extent permitted by applicable law, BabaWin and its directors, officers, employees, agents, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, even if BabaWin has been advised of the possibility of such damages.

BabaWin's total aggregate liability to any Player arising from or related to these Terms or the use of the Platform shall in no event exceed the total amount of real funds held in that Player's Account at the time the claim arises.

The Platform is provided on an "as is" and "as available" basis. BabaWin makes no warranties, express or implied, regarding the availability, reliability, or suitability of the Platform for any particular purpose.

12.1 Termination by BabaWin

BabaWin reserves the right to suspend or permanently close any Account, with or without prior notice, in the event of: (a) breach of any provision of these Terms; (b) suspected fraudulent activity, money laundering, or other illegal conduct; (c) provision of false information during registration or KYC; (d) chargebacks or payment disputes initiated by the Player; (e) regulatory requirements or instructions from competent authorities; or (f) any other circumstance in which BabaWin determines, at its sole discretion, that continued Account operation is not in the best interests of the Platform or its users.

12.2 Voluntary Closure by Player

Players may close their Accounts at any time by contacting BabaWin customer support via live chat. Prior to closure, all wagering requirements on active bonuses must be satisfied or the Player must accept forfeiture of any remaining Bonus Funds. Verified real money balances will be returned to the Player via their registered withdrawal method following account closure, subject to standard processing times and AML checks.

12.3 Effect of Termination

Upon Account termination, all rights and licences granted to the Player under these Terms shall immediately cease. Clauses relating to intellectual property, limitation of liability, prohibited conduct, and governing law shall survive termination of this Agreement.

BabaWin reserves the right to amend, update, or replace these Terms at any time. Where amendments are material, BabaWin will endeavour to provide reasonable advance notice to Players via email to their registered address or through a prominent notice on the Platform. Non-material amendments may be made without specific notice.

Your continued use of the BabaWin Platform following the publication of amended Terms constitutes your acceptance of the revised Terms. If you do not accept any amendment, you must close your Account and cease using the Platform before the effective date of the amendment. The date of last revision is displayed at the top of this document.

These Terms shall be governed by and construed in accordance with the laws and regulations applicable to BabaWin's operating jurisdiction. Any dispute arising out of or in connection with these Terms that cannot be resolved amicably between the parties shall be subject to binding arbitration in accordance with the rules of a recognised international arbitration body.

Players are encouraged to resolve any concerns through BabaWin's internal dispute resolution process in the first instance by contacting our support team. BabaWin will use commercially reasonable efforts to resolve Player disputes within five (5) business days of receipt of a formal written complaint.

Nothing in this clause shall prevent either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.
